Rental Agreement and Booking Terms & Conditions

Deposit Policy:
Reservations will be converted to bookings upon the client paying a deposit of 30% of the accommodation cost for bookings made at least 90 days prior to the arrival date.  Deposit must be received within 7 days after notification of the reservation or the date 90 days prior to the departure date, whichever occurs first.  The balance of the accommodation cost must be paid no later than 30 days prior to the arrival date.  A reservation will lapse if the client does not pay the deposit by the due date for the relevant payment.

A binding contract will be formed when the booking is confrimed in writing on behalf of Barnscape Pty Ltd (De Coudie Beach House), which it will do on receipt of the deposit.  Barnscape Pty Ltd (De Coudie Beach House) reserves the right to withdraw, change, cancel or reallocate the accommodation and the arrival date at its discretion until the booking is confirmed.  Clients must submit requests for variations in writing.

Booking Policy:
Balance or payment must be made in full 30 days prior to the date of arrival.  For bookings made within 60 days of travel, payment must be received within 48 hours of booking.  To confirm all bookings, full payment is required in advance.

Cancellation Policy:
Any cancellation of reservations by the client must be provided in writing, and are subject to payment of the cancellation fees set out below and will be effective only upon returned written acknowledgement.

If a cancellation is received more than 45 days prior to the arrival date, the deposit paid or a full refund of monies will be refunded where applicable.

If a cancellation is received 45 days or less prior to the arrival date but at least 30 days before the arrival date, a charge 30% of the booking cost is the cancellation fee.

If a cancellation is received less than 30 days prior to the arrival date, a charge 100% of the booking cost is the cancellation fee.

Booking Payment Procedures:
Please advise the following when making a booking request:
- Guest full names & ages
- Rooming arrangements
- Arrival & departure dates
- Method & timings of arrival and departure

Validity of Rates:
Unless otherwise specified all rates are valid to 31 March 2016.  We reserve the right to amend rates should the cost of services increase beyond our control.

Unused Services:
No refunds can or will be given in connection with circumstances arising beyond the reasonable control of The Tailor Pty Ltd or Barnscape Pty Ltd (De Coudie Beach House) - i.e. flight delays by airlines/contracted charter companies or client failure to appear for accommodation.  No refund can be given for any unused services or early departures.

Bond:
At the time of booking a credit card must be provided for pre-authorisation, which will hold the bond of AU$1000.00. No charges will be debited, provided booked numbers of people are not exceeded and there is no property damage, missing items, late departure, extra cleaning or any other additional expenses resulting from your stay.  Further payments may be required if there is loss or damage exceeding this amount. Pre-authorised credit card options for the bond are Visa, Mastercard or American Express. In all instances a credit card authorisation form must be completed and returned prior to your stay via fax to +61 8 8354 4406.

House Manager:
A house manager must be nominated as the primary contact and take full responsibility to ensure that all occupants understand and agree to the rules and conditions.  A mobile phone number must be provided and be contactable when occupying the residence 24/7 for security purposes.

Property Usage:
The property is to be used for short term residential accommodation only.  The property may not be used for any commercial purpose, wedding, party, gathering or any other function.

Check-In, Check-Out & Keys:
Our property caretakers, will meet you at the property at your agreed time and hand over keys.  We require your arrival time as the caretakers do not live on site.  A $100.00 fee will be charged for late arrivals if the caretaker needs to leave and return and lost keys / replacement locks will also be charged to your card.

Telephone:
The phone is connected for local calls only.

Parking:
There is covered parking for two cars only.

Housekeeping:
Extra services during your stay can be arranged for an additional fee.  On arrival and in the unlikely event the house requires further housekeeping or if there is a minor maintenance issue, please inform our caretakers immediately.  They will coordinate the appropriate team to fix the problem as soon as practically possible.

Maintenance & Garbage Removal:
The occupant is required to leave the property in the same clean, neat and tidy condition, as it was when they arrived.  Including washing up, fridge cleaned out, BBQ cleaned and rubbish to be place in appropriate bins on vacating the property.  Additional cleaning may be charged against the security deposit.

Smoking & Pets:
There is no smoking allowed inside the house.  Pets are not allowed on the property.

Loss, Damage or Injury:
Barnscape Pty Ltd (De Coudie Beach House) takes no responsibility for loss of tenant's property, or personal injury.  Guests should report breakages and are responsible for loss or damage of property belonging to them and for the damage or loss of property belonging to the property during their stay.  We recommend travel/health insurance in the event of accident, sickness or cancellation caused by transport problems or illness.  Please note, the beach house is surrounded by natural bush land and there maybe bugs from time to time.  If you are sensitive, please ensure you use an insect repellant and wear covered shoes if you are bush walking in the area.

Noise, Parties & Behaviour:
The house is for registered guests only.  Parties are not permitted under any circumstances and there is to be no disturbing noise between 10pm to 8am with no excessive noise at any other time.  A $100.00 deduction will be charged with each security or caretaker callout.  If after one warning for noise or if your behaviour or that of your guests causes damage, danger or annoyance we reserve the right to ask you to vacate the property immediately and be treated as a cancellation inside 30 days.

Miscellaneous:
As this is a private house and not a hotel with staff where rooms can be swapped, we cannot offer alternative accommodation or a refund for minor problems if they can be easily fixed - or if the property is not to your individual taste.  A breach of any of the above conditions will permit Barnscape Pty Ltd (De Coudie Beach House) or their agents to cancel or amend a booking, refuse access or occupation, or immediately terminate a tenancy.  Refunds will not be paid on terminated tenancies.  All details must be filled out correctly and payment processed before the confirmation of the booking.

A hard copy of this agreement will be issued to be signed and agreed to at confirmation of reservation.
